Se remitió el expediente al Juzgado Segundo Penal Municipal de Soacha para que adelante la correspondiente actuación judicial, toda vez que de acuerdo con el Decreto 1382 de 2000 era el Juez competente para conocer de la acción y debió pronunciarse de fondo sobre lo solicitado, conforme con los criterios establecidos por el Decreto 2591 de 1991 y no diferir el asunto, planteando un conflicto de competencia que ha dado como resultado que el petente, no haya recibido a la fecha una solución sobre el asunto puesto a consideración.
Es más, teniendo en cuenta que el derecho cuya protección solicita el accionante es el debido proceso, derecho constitucional fundamental, no entiende la Sala, como no hubo un pronunciamiento sobre la violación o no del mismo, sino la remisión a la Jurisdicción Contencioso Administrativa.
